   Mr. Paul introduced the following bill; which was referred to the 
Committee on Ways and Means, and in addition to the Committee on Energy 
    and Commerce, for a period to be subsequently determined by the 
  Speaker, in each case for consideration of such provisions as fall 
           within the jurisdiction of the committee concerned

 To repeal sections 1173(b) and 1177(a)(1) of the Social Security Act, 
                        and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

     This Act may be cited as the ``Patient Privacy Act''.

SEC. 2. REPEALS.

    (a) Social Security Act.--Sections 1173(b) and 1177(a)(1) of the 
Social Security Act (42 U.S.C. 1320d-2(b) and 1320d-6(a)(1)) are 
repealed.
    (b) HIPPA.--Section 264(c) of the Health Insurance Portability and 
Accountability Act of 1996 (42 U.S.C. 1320d-2 note) is repealed.
    (c) Regulations.--Beginning on the date of the enactment of this 
Act, any regulation issued under the authority of a provision repealed 
by this section shall have no force or effect.

SEC. 3. PROHIBITION ON EXPENDITURE OF FEDERAL FUNDS.

    (a) In General.--Notwithstanding any other provision of law, no 
Federal funds may be spent to develop or implement any database or 
other system of records containing personal medical information of any 
United States citizen, or to collect medical records for the purpose of 
storing them in a database or other system of records.
    (b) Exceptions.--Subsection (a) shall not apply to personal medical 
information collected for the sole purpose of administering any of the 
following:
            (1) Part A or part B of the Medicare program under title 
        XVIII of the Social Security Act.
            (2) The medicaid program under title XIX of the Social 
        Security Act.
            (3) The health care program for active military personnel 
        under title 10, United States Code.
            (4) The veterans health care program under chapter 17 of 
        title 38, United States Code.
            (5) The Civilian Health and Medical Program of the 
        Uniformed Services (CHAMPUS), as defined in section 1072(4) of 
        title 10, United States Code.
            (6) The Indian health service program under the Indian 
        Health Care Improvement Act (25 U.S.C. 1601 et seq.).
            (7) The Federal Employees Health Benefit Plan under chapter 
        89 of title 5, United States Code.
