                                 A BILL


 
To amend the Elementary and Secondary Education Act of 1965 to require 
  States, in awarding subgrants under the State charter school grant 
   program, to give priority to charter schools that will provide a 
              racially integrated educational experience.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. PRIORITY TO CHARTER SCHOOLS PROVIDING A RACIALLY INTEGRATED 
              EDUCATION.

    Section 5204(f) of the Elementary and Secondary Education Act of 
1965 (20 U.S.C. 7221c(f)) is amended by adding at the end the 
following:
            ``(7) Priority.--In awarding grants or subgrants under this 
        part, the Secretary and State educational agencies shall give 
        priority to eligible applicants planning or implementing a 
        charter school located in a jurisdiction of a local educational 
        agency based on evidence that--
                    ``(A) the school will provide a racially integrated 
                educational experience; and
                    ``(B) the local educational agency is undertaking 
                outreach to students from diverse backgrounds.''.
