To amend title 49, United States Code, to provide an apportionment to a 
   primary airport that falls below 10,000 passenger boardings in a 
calendar year as a result of the discontinuance of air carrier service 
                at the airport, and for other purposes.

  Mr. Stupak introduced the following bill; which was referred to the 
             Committee on Transportation and Infrastructure


                                 A BILL

To amend title 49, United States Code, to provide an apportionment to a 
   primary airport that falls below 10,000 passenger boardings in a 
calendar year as a result of the discontinuance of air carrier service 
                at the airport, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled, That section 
47114(c)(1) of title 49, United States Code, is amended by adding at 
the end the following:
                    ``(F) Grandfather clause.--Notwithstanding 
                subparagraph (A), the Secretary may apportion to an 
                airport sponsor in a fiscal year an amount equal to the 
                amount apportioned to that sponsor in the previous 
                fiscal year if the Secretary finds that--
                            ``(i) passenger boardings at the airport 
                        are below 10,000 in the calendar year used to 
                        calculate the apportionment as a result of the 
                        discontinuance of air carrier service to and 
                        from the airport in any of the 3 calendar years 
                        preceding the calendar year used for such 
                        calculation; and
                            ``(ii) the airport had at least 10,000 
                        passenger boardings in any of such 3 preceding 
                        calendar years.''.
