A BILL
To amend the Temporary Extended Unemployment Compensation Act of 2002
to provide for additional weeks of benefits to exhaustees; to modify
the AIUR trigger used in determining eligibility for second-tier
benefits; and to provide for an extension of the temporary extended
unemployment program.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. ADDITIONAL WEEKS OF BENEFITS.
(a) In General.--Section 203 of the Temporary Extended Unemployment
Compensation Act of 2002 is amended by adding at the end the following:
``(d) Additional Weeks of Benefits.--Notwithstanding any other
provision of this section, upon the exhaustion of all amounts that may
be credited to an individual's account under the preceding provisions
of this section, such account shall be increased by an amount equal to
6 times the individual's average weekly benefit amount for the benefit
year (as determined under subsection (b)(2)), but only if such
exhaustion occurs before December 29, 2002.''.
(b) Effective Date.--The amendment made by subsection (a) shall
take effect as if included in the enactment of the Temporary Extended
Unemployment Compensation Act of 2002, except that no amount shall be
payable by virtue of such amendment for any week of unemployment ending
before the date of the enactment of this Act.
SEC. 2. MODIFIED AIUR TRIGGER FOR SECOND-TIER BENEFITS.
(a) In General.--Subsection (c) of section 203 of the Temporary
Extended Unemployment Compensation Act of 2002 is amended by adding at
the end the following:
``(3) Modified aiur.--For purposes of any determination
under paragraph (2), rates of insured unemployment shall be
determined in the same manner as would (disregarding this
paragraph) otherwise apply, except that individuals exhausting
their rights to regular compensation during the most recent 3
calendar months for which data are available before the close
of the period for which such rate is being determined shall be
taken into account as if they were individuals filing claims
for regular compensation for each week during the period for
which such rate is being determined.''.
(b) Effective Date.--The amendment made by subsection (a) shall
apply for purposes of making any determination which is based on an
exhaustion of rights occurring on or after the date of the enactment of
this Act.
SEC. 3. PROGRAM EXTENSION.
(a) Extension.--Section 208 of the Temporary Extended Unemployment
Compensation Act of 2002 is amended to read as follows:
``SEC. 208. APPLICABILITY.
``(a) In General.--Except as provided in subsection (b) or (c), an
agreement entered into under this title shall apply to weeks of
unemployment--
``(1) beginning after the date on which such agreement is
entered into; and
``(2) ending before December 28, 2003.
``(b) Transition Rule.--
``(1) In general.--Subject to paragraph (2) and subsection
(c), in the case of an individual who has amounts remaining in
an account established under section 203 as of December 27,
2003, temporary extended unemployment compensation shall
continue to be payable to such individual from such amounts for
any week beginning after such date for which the individual
meets the eligibility requirements of this title.
``(2) End of supplementation.--Subsection (c) and (d) of
section 203 shall cease to be effective as of December 27,
2003.
``(c) Sunset Provision.--Notwithstanding any other provision of
this title, no temporary extended unemployment compensation shall be
payable under this title for any week beginning after March 27,
2004.''.
(b) Effective Date.--The amendment made by subsection (a) shall
take effect as of the date of the enactment of this Act or May 31,
2003, whichever is earlier, and shall apply to weeks of unemployment
beginning after that date.
