To amend the National Environmental Policy Act of 1969 to require that 
   Federal agencies consult with State agencies and county and local 
            governments on environmental impact statements.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``State and Local Government 
Participation Act of 2003''.

SEC. 2. CONSULTATION WITH STATE AGENCIES AND COUNTY AND LOCAL 
              GOVERNMENTS ON ENVIRONMENTAL IMPACT STATEMENTS.

    Section 102(2)(C) of the National Environmental Policy Act of 1969 
(42 U.S.C. 4332(2)(C)) is amended in the first sentence of the matter 
following clause (v) by striking ``any Federal agency which has'' and 
inserting ``each Federal agency, State agency, county government, and 
local government that has''.
