                                 A BILL


 
To make it a violation of a right secured by the Constitution and laws 
of the United States to perform an abortion with the knowledge that the 
 abortion is being performed solely because of the gender of the fetus.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Civil Rights of Infants Act''.

SEC. 2. DEPRIVING PERSONS OF THE EQUAL PROTECTION OF LAWS BEFORE BIRTH.

    Section 1979 of the Revised Statutes (42 U.S.C. 1983) is amended--
            (1) by inserting ``(a)'' before ``Every person''; and
            (2) by adding at the end the following:
    ``(b) For purposes of subsection (a), it shall be a deprivation of 
a `right' secured by the laws of the United States for an individual to 
perform an abortion with the knowledge that the pregnant woman is 
seeking the abortion solely because of the gender of the fetus. No 
pregnant woman who seeks to obtain an abortion solely because of the 
gender of the fetus shall be liable for such abortion in any manner 
under this section.''.
